DaySnip — Terms of Service

Effective Date: March 6, 2026

1. Acceptance

By downloading, installing, or using DaySnip ("the App"), you agree to these terms. The App is developed and published by moonshinerXwerks LLC. These terms are in addition to our general Terms of Service.

2. Description

DaySnip is a voice-first journaling app that captures daily thoughts via voice and text, then uses AI to compile them into cohesive journal entries. The App is rated 4+ on the App Store and is suitable for all ages.

3. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on devices you own or control, subject to these terms and Apple's App Store terms.

4. User Content

You retain ownership of any content you create within the App. By using the App, you grant us a limited license to process your content solely for the purpose of providing the App's features and functionality, including AI compilation.

5. Subscriptions and Free Trials

DaySnip+ is available at $2.99/month or $19.99/year and includes a 14-day free trial. If you do not cancel before the trial ends, your subscription will begin and you will be charged the applicable fee.

Therapy Prep is available at $2.99/month. New users receive 2 free weekly summaries to evaluate the feature before subscribing.

All subscriptions are managed and billed through Apple's App Store. Key terms:

Payment is charged to your Apple ID account at confirmation of purchase.
Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period.
You can manage and cancel subscriptions at any time through Settings → Apple ID → Subscriptions.
No refunds are provided for unused portions of a subscription period. Refund requests are handled by Apple in accordance with their policies.

6. AI-Generated Content

DaySnip uses artificial intelligence to compile your daily entries into journal wraps and to generate Therapy Prep summaries. You acknowledge and agree that:

AI-generated compilations and summaries are produced by automated systems and may contain inaccuracies, omissions, misinterpretations, or errors.
AI outputs should not be relied upon as the sole record of your thoughts, experiences, or emotional state.
You are responsible for reviewing AI-generated content for accuracy.
We do not guarantee the accuracy, completeness, or reliability of any AI-generated content.

7. Therapy Prep Disclaimer

The Therapy Prep feature generates AI-powered weekly summaries intended to help you prepare for therapy sessions. You acknowledge and agree that:

Therapy Prep is not a medical device and is not FDA-approved or regulated.
Therapy Prep is not a clinical tool and does not provide diagnosis, treatment, or medical advice.
Therapy Prep summaries are not a substitute for professional mental health care, therapy, counseling, or psychiatric treatment.
AI-generated summaries may be incomplete, inaccurate, or miss important context. They should be used as a starting point for conversation with your therapist, not as a definitive record.
If you are experiencing a mental health crisis, contact your local emergency services, call 988 (Suicide and Crisis Lifeline), or go to your nearest emergency room.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

The App will be uninterrupted, error-free, or free of harmful components
AI-generated content will be accurate, complete, or suitable for any particular purpose
Voice transcription will be error-free
Data sync across devices will be instantaneous or conflict-free

9. Prohibited Use

You may not reverse engineer, decompile, or disassemble the App; use the App for any unlawful purpose; attempt to gain unauthorized access to any systems connected to the App; or use automated means to access the App.

10. Limitation of Liability

To the fullest extent permitted by law, moonshinerXwerks LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to damages arising from reliance on AI-generated content, inaccurate transcriptions, data loss, or sync failures.

11. Termination

We may terminate or suspend your access to the App at any time for violation of these terms. Upon termination, your right to use the App ceases immediately. Active subscriptions must be cancelled separately through your Apple ID settings.

12. Changes

We may modify these terms at any time. If we make material changes, we will notify you through the App. Continued use of the App after changes constitutes acceptance.
